About the Campaign
Our campaign aims to bring justice for Manny, and create awareness of the Department of Educations disregard for IDEA laws. Laws that mandate a Free Appropriate Education to students of all abilities.
We believe that by holding the DOE accountable for their actions, we can reform the system to provide safety and support for all students.
We are committed to demanding compensatory replacement services for Manny and working towards systemic reform that will prevent similar cases from happening in the future, Protecting all Children with Disabilities.
Manny's Story
Read Manny's story detailing how the Department of Education violated numerous IDEA Laws to deny a Disabled Student, educational services:

Violation of IDEA Law Sec.300.322: The DOE is mandated to conduct an annual IEP (Individualized Education Plan) for students requiring Special Education. On June 25, 2019, an IEP meeting was scheduled for Manny. Due to a Medical condition, he suffered a seizure that day, requiring emergency hospitalization. Despite the mother informing the IEP team and requesting a reschedule, the DOE proceeded with the meeting without the parent, violating parental participation rights.

Fraudulent IEP: The DOE conducted the IEP meeting without parental presence and falsely claimed that the Parent rejected a residential boarding school placement for Manny. However, as the parent was not present at the meeting, how did they voice the rejection? Furthermore, the parent had been actively seeking such a placement for Manny. The fraudulent IEP misrepresented the parent's stance, thus depriving Manny of necessary services.

Failure to Provide IEP: Despite assurances from the DOE that they would send the parent a copy of the IEP, they failed to do so, thereby violating IDEA Law Sec.300.322 requiring the agency to provide parents with a copy of the child’s IEP within a specific timeframe.

Continued Violations: The DOE offered an inappropriate interim school, yet failed to send the necessary consent forms to facilitate such placement, thus further obstructing Manny's access to much needed educational services.

Hearing Officer David Gronbach

Manny's parents are currently engaged in a Due Process Hearing to seek compensation for lost services for Manny. Compensation that would and could provide, appropriate services to try and catch up for the loss of time. However, Hearing Officer Gronbach has repeatedly denied the parent and Manny's right to a fair hearing, violating basic principles of Due Process. Despite overwhelming evidence, the DOE and Hearing Officer Gronbach refuse to concede, prompting legal action to ensure that Manny receives proper necessary compensation of services and support.
